The Federal Government has increased the allowable work hours cap from 40 hours per fortnight to 48 hours per fortnight for student visa holders.
From 1 July 2023, student visa holders can work up to 48 hours per fortnight while studying. There are no work restrictions when the course is not in session (during semester breaks).
The relaxation of student visa work restrictions during the pandemic which permitted student visa holders to work over the previous limit of 40 hours per fortnight ended on 30 June 2023.
Are there any exemptions to the cap?
Any student visa holders that were working in the aged care sector as of 9 May 2023 may work unrestricted hours in that sector until 31 December 2023.
What are the rules?
Student visa holders must know their visa conditions, including their work rights. The Visa Entitlement Verification Online (VEVO) tool can be used to check visa details and conditions.
Employers must continue to follow Australian workplace laws. Overseas workers, including international students, have the same rights as all other employees.
